Article 1 – Definitions

  1. Cooling-off period: the period within which the consumer can make use of their right of withdrawal.
  2. Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  3. Day: calendar day.
  4. Long-term transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligations of which are spread over time.
  5. Durable data carrier: any medium that enables the consumer or entrepreneur to store information in a way that allows future consultation and unaltered reproduction of the stored information.
  6. Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period.
  7. Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
  8. Distance contract: a contract concluded within the framework of a system organized by the entrepreneur for distance sales of products and/or services, whereby exclusive use is made of one or more techniques for distance communication.
  9. Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being together in the same place at the same time.

Article 3 – Applicability

  1. These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between entrepreneur and consumer.
  2. Before the distance contract is concluded, the text of these terms and conditions shall be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms and conditions are available for inspection at the entrepreneur’s premises and will be sent free of charge to the consumer upon request.
  3. Placing an order or accepting an offer implies acceptance of these terms and conditions by the consumer.

Article 4 – The Offer

  1. If an offer has a limited validity period or is made under conditions, this will be expressly stated in the offer.
  2. The offer contains a complete and accurate description of the offered products and/or services. If images are used, they are a true representation of the products and/or services offered. Obvious mistakes or errors do not bind the entrepreneur.

Article 5 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.
  2. If the consumer has accepted the offer electronically, the entrepreneur shall confirm receipt of the acceptance of the offer without delay by electronic means. As long as the receipt of this acceptance has not been confirmed, the consumer may dissolve the contract.
  3. If the contract is concluded electronically, the entrepreneur shall take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, the entrepreneur shall take appropriate security measures.
  4. The entrepreneur may, within the legal framework, ascertain whether the consumer can meet their payment obligations, and all facts and factors relevant to a responsible conclusion of the distance contract. If the entrepreneur has good grounds not to enter into the contract, he is entitled to refuse an order or to attach special conditions to its execution.
  5. Upon delivery of the product or service, the entrepreneur shall provide the consumer with the following information in writing or in such a way that the consumer can store it on a durable data carrier: (a) the complaints address info@laser-point.nl; and (b) the information referred to in Article 4, unless this information has already been provided before performance of the contract.
  6. In the case of a long-term transaction, the provision in the previous paragraph only applies to the first delivery.

Article 6 – Price

  1. As long as the agreement has not been concluded, the entrepreneur is entitled to change prices, offers and conditions. Consumers cannot derive rights from prices or offers from the (recent) past.
  2. All prices stated include 21% VAT.
  3. Obvious mistakes or errors in the offer do not bind the entrepreneur.

Article 7 – Delivery and Execution

  1. The entrepreneur will exercise the greatest possible care when executing orders.
  2. The place of delivery is the address provided by the consumer to the entrepreneur.
  3. Target delivery times: digital files within 10 working days (no later than 30 days); canvas products within 15 working days (no later than 30 days); fill-in booklets within 2 working days. If delivery is delayed, the consumer will be informed no later than 30 days after placing the order.
  4. The entrepreneur is not liable for delays caused by postal or parcel services.
  5. The entrepreneur is not liable for damages as a result of exceeding stated delivery times.
  6. If delivery of a product proves impossible, the entrepreneur will endeavor to make a replacement article available. This will be clearly communicated at the latest upon delivery. In the case of replacement items, the right of withdrawal remains applicable. The costs of a return shipment of replacement items are borne by the entrepreneur.
  7. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or their designated representative, unless expressly agreed otherwise. Minor shipping damage, such as light creases, are excluded.

Article 8 – Complaints, Returns and Right of Withdrawal

  1. The consumer must check the items immediately upon receipt and report any defects as soon as possible; the entrepreneur will work with the consumer to find a suitable solution.
  2. During the cooling-off period, the consumer must handle the product and packaging with care. Unpacking is only permitted to the extent necessary to assess the product. When exercising the right of withdrawal, the product must be returned complete, in original condition and – if reasonably possible – in the original packaging, according to the provided instructions.
  3. The consumer has the right to return items within 14 days after the statutory 14-day cooling-off period, unless one of the exceptions below applies.
  4. The costs of return shipping are borne by the consumer; the consumer is responsible for proper packaging and shipment.
  5. For timely, unused and undamaged returns, the entrepreneur will refund the purchase price including the original shipping costs no later than 14 days after receipt of the return; products must be free of odors such as smoke or perfume.
  6. Exceptions to the right of withdrawal:
    • The right of withdrawal does not apply to products made according to the consumer's specifications, which are not prefabricated, which are produced based on an individual choice or specification of the consumer, or which are clearly intended for a specific person.
    • This includes, among others, personalized products, custom-made items and specially manufactured products. Returns of these products are not accepted.

Article 9 – Payment

  1. The contract is concluded once the consumer accepts the offer and meets the conditions; as long as the acceptance has not been confirmed by email, the consumer can dissolve the contract.
  2. The consumer is obliged to report inaccuracies in payment details immediately.
  3. Payment is possible via iDEAL.

Article 10 – Complaints Procedure

  1. Complaints can be submitted by email via info@laser-point.nl.
  2. The entrepreneur has a complaints procedure and handles complaints in accordance with this procedure.
  3. Complaints regarding the execution of the contract must be submitted as soon as possible, fully and clearly described.
  4. Complaints will be answered within 14 days. If more time is needed, the consumer will receive a confirmation within 14 days indicating when a full response can be expected.
  5. Consumers can also submit disputes via the ODR platform: http://ec.europa.eu/consumers/odr/.

Article 11 – Liability

  1. Any liability of the entrepreneur for direct or indirect damage, of any nature whatsoever, is excluded, unless there is intent or gross negligence.
  2. The entrepreneur accepts no liability for damage arising from the use of its products.
  3. The entrepreneur’s liability is always limited to a maximum of the purchase price of the relevant item.
  4. The entrepreneur is not liable for misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of internet or other means of communication, unless there is intent or gross negligence.
  5. The entrepreneur accepts no liability for products after they have been used or modified, including possible fading of colors of applied colorants.

Final Provision

These terms and conditions, including the references they contain, apply to every agreement between Laser Point and the consumer. The entrepreneur reserves the right to amend these terms and conditions; the most recent version will always apply.
